Terms of Hire

These Terms apply to each Wagga Skips booking. The booking confirmation records the bin size, waste type, included weight, hire period, price and any special conditions. A customer who confirms a booking after receiving these Terms, or accepts delivery under that booking, agrees to be bound by them.

1. Ownership and Permitted Use

All bins and related equipment remain the property of A.N COX & M COX trading as Wagga Skips.

The customer must use the equipment only for the agreed purpose, keep it secure and in reasonable condition, and must not move, alter, burn material in, mechanically compact, sell, sub-hire or interfere with it without approval from Wagga Skips.

2. Delivery, Placement and Access

The customer must provide firm, unobstructed and lawful access suitable for a heavy vehicle at delivery and collection.

The customer is responsible for obtaining any permission or council approval required for placement on a road, nature strip or other land not controlled by the customer.

The customer must identify underground services, irrigation, septic systems and weak or restricted surfaces before placement.

Wagga Skips may refuse or postpone service where access, overhead clearance, ground conditions, load condition or placement is unsafe or unlawful.

A reasonable call-out or additional transport charge may apply where a service cannot be completed because the site or access does not meet these requirements.

3. Service Area and Travel Surcharge

Bin prices include delivery and collection within the Wagga Wagga urban area.

Jobs outside this area may incur a travel surcharge based on distance. The surcharge covers both delivery and collection and will be confirmed at the time of booking.

4. Waste Types and Prohibited Material

Only the waste type confirmed in the booking may be placed in the bin.

Asbestos, fibro, cement sheeting, hazardous or regulated waste, liquids, contaminated soil, chemicals, paint, oil, batteries, medical waste, flammable or explosive material and any other material prohibited by the receiving facility must not be placed in a bin.

Mattresses, tyres, refrigeration units or whitegoods containing gas, gas bottles and fire extinguishers are restricted items. They must be declared and accepted at booking, or before they are placed in the bin, and may attract the applicable item charge.

Gas bottles and fire extinguishers must not exceed 20kg unless specifically agreed.

If prohibited, undeclared or incorrectly classified material is found, Wagga Skips may suspend collection or disposal.

The customer must pay the reasonable additional costs directly caused by the material, including reclassification, testing, handling, transport, return, disposal, decontamination and administration.

5. Loading and Weight

Waste must be evenly distributed and must not extend above the top rim or marked fill line. Nothing may protrude from the bin.

Wagga Skips may refuse to transport an overloaded, unstable or unsafe bin until it is made safe. A reasonable return visit or waiting charge may apply.

The hire price includes only the weight allowance stated in the booking.

Net disposal weight is determined from the receiving facility's weighbridge or disposal record. Weight above the included allowance is charged at the applicable rate stated in the booking or current price schedule.

A copy of the disposal record will be provided on reasonable request.

Moisture and rainwater form part of the measured disposal weight. Customers should cover moisture-sensitive loads where safe and practical.

Extra weight caused solely by an unreasonable collection delay by Wagga Skips after an agreed collection date will be considered fairly and will not be automatically passed on to the customer.

6. Hire Period and Collection

The included hire period is the period shown in the booking.

The customer must request collection and keep the bin accessible until collected.

Extended-hire charges may apply after the included period, except for a delay caused solely by Wagga Skips.

Delivery and collection times are reasonable estimates and are not guaranteed appointment times. Wagga Skips will communicate material delays where practical.

Changes or cancellations after a truck has been dispatched may attract the reasonable costs already incurred.

7. Damage, Loss and Site Responsibility

The customer is responsible for loss of or damage to Wagga Skips equipment beyond fair wear and tear where caused by the customer, site occupants, visitors or contractors.

Reasonable repair, cleaning or replacement costs may be charged.

Wagga Skips will take reasonable care when entering the site and placing or collecting a bin.

Heavy vehicles and loaded bins can mark or damage surfaces. Where the customer requests placement on a driveway, path, lawn, kerb or other surface, the customer accepts the ordinary risk of damage inherent in that requested placement.

This does not apply to the extent that the loss is caused by negligence by Wagga Skips, a breach of these Terms or a right that cannot lawfully be excluded.

8. Payment and Additional Charges

Booking charges, including any travel surcharge confirmed at booking, are payable as agreed.

Additional weight, restricted items, contamination, extended hire, failed access and customer-caused loss or damage will be itemised and invoiced after they are known.

Amounts are payable by the due date shown on the invoice.

Wagga Skips may charge an existing payment method only where the customer has separately authorised this.

Any additional charge must reflect the applicable published or agreed fee, or the reasonable cost incurred.

The customer should contact Wagga Skips promptly if an amount appears incorrect.

9. Our Service Obligations

Wagga Skips will provide equipment reasonably fit for the agreed purpose, perform delivery and collection with due care and skill, and dispose of accepted waste through an appropriate facility in accordance with applicable requirements.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded.
